My office has received an increase in calls from potential clients who were either arrested or cited for contracting without a license. Whether we agree with it or not, it is against the law for a person to offer any kind of construction service for a value exceeding a $1,000 if they do not have a contractor’s license.   Keep in mind, it’s not just illegal to perform the service, it is illegal to even bid on jobs that exceed $1,000 if you don’t have a license.

What Are the Consequences for this Offense?

If you are convicted of this offense you may be ordered to serve jail time, placed on probation and pay an incredibly large fine. The most important consequence, however, is that a conviction on your record may very well prevent you from ever receiving your contractor’s license. As an attorney, this law has never made a lot of sense. I can’t understand how a person can be penalized for contracting without a license and the penalty can result in them never receiving their license.   I believe it would be more just to have people pay a fine and mandate that they apply for a license.
